What Are The Biggest Myths of Divorce Court?
This week, Karen Wagner explains the most common myths regarding divorce court.
Myth #1: Custody
It is a common myth that a mother will always win custody of the children. It is a balancing of what is equal and right for the child. We do our best to advocate for the parent’s interests but the court will focus on the best interest of the child. This might not mean that either parent gets exactly what they want.
Myth #2: Adultery
It is a common myth that if one spouse commits adultery, that the other party will get everything. This is not the case in Maryland, the only time the court considers adultery is when it is going through the multiple factors to determine if alimony is appropriate. It is true that adultery can impact the amount or duration of any alimony awarded.
